Since the NIH Grants Policy Statement specifically addresses grants to for-profit organizations, you may want to highlight these terms to the company: http://grants.nih.gov/grants/policy/nihgps/HTML5/section_18/18.4_administrative_requirements.htm

Our university has been award an NIH grant and the Professor who was awarded now wants to subgrant money to a company. We have never subgranted out of a NIH to a company before, so this is new. We have subgranted to other universities though. This company is named in the application to the NIH and is working collaboratively with our Professor. My question is – what contract template should we put in place? There are a few templates I have used in the past with other universities from the FDP website, which include:
I don’t believe the above are appropriate templates but appreciate any input you may have to offer. Is there a template that your institution has used when subgranting to a company that you can share?
