  • 1.  Foreign eligibility as a subaward

    I apologise for the potentially silly question but the EU rules have cast doubt on my interpretation of NIH rules for eligibility and I need some clarification. Can a subaward be foreign in an NIH call that excludes foreign participation? The reason I am asking is that a PI at our institute has been asked to be a subaward on a call that states that the eligible applicants are: Resource-constrained Non-domestic (non-U.S.) Entities (Foreign Organizations) ONLY.

    My first thought is that we cannot participate since Sweden is not a LMIC - but I would appreciate confirmation!

    Hi Laura,

    An institution of Sweden is not eligible to be a prime applicant.

    However, the funding opportunity should specifically address "foreign components" (such as subrecipients).  For example, it might say "Foreign components, as defined in the NIH Grants Policy Statement, are not allowed." -- In this example, your institution could not participate in the opportunity.

    Thanks Janet. It did say that so I am happy that our PI decided to decline the application before he had put in too much effort!
