We are working with an institution now, and the NIH GMS indicated we could use 10%. There is nothing official, so we will have decided to include a statement in the justification indicating that "we have requested 10% consistent with the new Uniform Guidance for institutions without an F&A rate." We thought it was best to be transparent on why we were not using the published 8%. Then when/if we are awarded we will run the subcontract under any clarifying guidance the NIH issues in the next year.
We don't want to miss an opportunity! So we fell back on the idea of asking and adjusting in post award. As soon as NIH clarifies officially, we will use that rate and not put a statement in the justification anymore.

As a foreign institution what indirect cost rate (F&A) are you using in new applications to the NIH since the introduction of the Uniform Guidance in December 2014? The GPS and SF424 have not been changed and no new notices have been released as far as I have seen.
